An abridged version of the Will by Jonathan Rawes, preceeded by an itemising of the Will by Bryant Bayliffe.


The Will was Made 8th May 1775 and PROVED (P.C.C. London, Prob 11/1034 Quire No 348.) 16 Aug. 1777 by Roope Harris Roope Esquire, sole executor.

Margaret Deeble was the aunt of Cabel Roope who died young in 1742 and the Will is important in identifying her heir Roope Harris Roope and his inheritance of the Greenway Estate on the river Dart.

Margaret Deeble of the Borough of Plymouth co. Devon Widow….to be buried in a leaden Coffin in Charles Church in Plymouth as near to my first husband Mr John Lavington as possible. And my will and desire is to be Buried in the same or like manner as my late husband was except as to Escutcheons which I do not approve of but in Lieu thereof I give unto the Minister that shall bury me and to each of my Upper Bearers a Ring of a Guinea values besides other Mourning….

Whereas by a certain Indenture bearing date on or about the 23rd January 1743 and made between my late Husband Edward Deeble Esquire and me his then wife of the one part and John Huxham of Plymouth aforesaid Doctor in Physic and George How of the same place Gentleman (both since deceased) of the other part It was and is covenanted and agreed that my said Husband Edward Deeble and me should and would pay(?)….to the said John Huxham and George How their Heirs and Assigns a fine of all those parts and parcels of all that the capital messuage Barton Farm and Demesne Lands of or called Greenaway and of divers Lands Mills Tenements…within the several Parishes of Brixham and Thurston Ferrers co. Devon which were formerly purchased by one Thomas Martyn Merchant dec’d from Humphrey Gilbert Esquire and Daniel Vinnicombe Gentleman or [ ] of them consisting of the several Particulars therein mentioned. And also of all that Messuage….called….Washbourne otherwise Washbourne Bowson otherwise Laverses Washbourne situate….in Washbourne Bowson, Rowdon East Rowdon otherwise Eastmost Rowdon within the parish of Halwell otherwise Halwell co. Devon. And also of all those several closes or parcels of Land….situate in the Parish of Harberton co. Devon. And also of all that Messuage….known by the name of Chipton….within the parish of Dittisham co. Devon. And also of all that Messuage….situate in Totness co.Devon. And of all other the Messuages Lands Tenements.…of my deceased Nephew Cabell Roope, upon whose death the same descended and came unto me as his only Aunt and Heir at Law situate…within the several Parishes of Thurston Ferrers, Brixham, Halwell, Harberton, Dittisham, Totness and the Borough of Totness or elsewhere in the county of Devon which said ffine so covenanted

and agreed to be levied of the said Lands Tenements….was thereby declared to be and enure to the use and behoof of my said late Husband Edward Deeble and his Assigns….and after his decease then to the use and behoof of such persons.…as I the said Margaret Deeble should….direct….And for want of such direction….then to the use and behoof of me the said Margaret Deeble….my Heirs and Assigns forever. And whereas by Indentures of Lease and Release bearing date 12 & 13 April 1771 I the said Margaret Deeble have granted and conveyed unto Roope Harris and his Heirs all that Division or Allotment called the first Division of the capital Messuage Barton ffarm and Demesne Lands called Greenway and of divers Lands Mils Tenements….of the said Capital Messuage Barton ffarm….within the parishes of Brixham and Thurston Ferrers co Devon formerly purchased by the said Thomas Martyn from the said Humphrey Gilbert and Daniel Vinnicombe To hold the same unto the said Roope Harris his Heirs and Assigns for ever….And whereas the said Roope Harris is my Kinsman or Relation and his present Majesty hath by his Letters Patent lately granted unto him the said Roope Harris (by the Name and Addition of Roope Harris of the City of Bristol Esqre where he then resided but now resides at Dartmouth co. Devon) and his Heirs full Power and Authority to assume and take the surname of Roope and also to bear the Arms of Roope in compliance with my request. Now I the said Margaret Deeble by virtue of the powers reserved unto me in and by the said first Indenture And of the said ffine….Do by this my last will….grant….unto the said Roope Harris now called Roope Harris Roope.…under….Letters Patent….All and singular the said Lands Tenements….called the First Division or Allotment of the Capital Messuage Barton ffarm….by the said recited Indentures of Lease and Release of the 12 & 13 April 1771 granted unto the said Roope Harris (now Roope Harris Roope) and his Heirs….forever. And I the said Margaret Deeble ….do grant….unto the said Roope Harris Roope all my….other Messuages….comprised in the said first recited Indenture of the 23 January 1743….and all other Messuages ….whatsoever of me the said Margaret Deeble….situate in the parishes of Halwell, Harberton, Dittisham & Totness and the Borough of Totness or elsewhere in co. Devon….during the term of his natural life. And from and after his decease then….the aforesaid Messuage known by the name of Chipton….within the parish of Dittisham I grant to George Roope

eldest son of the said Roope Harris Roope and his Heirs….and in default of such,….unto the right Heirs of the said Roope Harris Roope for ever….And the Messuages….known as Washbourne….(identified as above)….And also those the aforesaid….situate in the parish of Harberton….and also that aforesaid Messuage….lying in Totness, And all the Reminder or other Messuages….whereof I am seized….lying within the several parishes of Halwell, Harberton, Totness and the Borough of Totness or elsewhere in co. Devon, I grant the same….to Jonah Lavington Roope youngest son of Roope Harris Roope and his Heirs….for ever. Provided always that I do hereby give full power and authority to the said Roope Harris Roope from time to time to….make any Lease or Leases in possession not in Reversion or Remainder or by way of future Interest of all or any of the said Premises….for any term of years not exceeding 21 years….As to that my Messuage….situate in the Borough of Saltash co. Cornwall, and also that my Wood and parcel of Woodland now or anciently called Bond’s Wood….lying in the Parish of Sheviock co. Cornwall…and all other Lands, Tenements….whereof I am now seized in ffee simple or any other Estate of Inheritance situate in Saltash and Sheviock or elsewhere in co. Cornwall, I give and devise the same to my Godson Edward Peter (youngest son of Samuel Peter late of Plymouth Esquire deceased), his Heirs and Assigns for ever. I give and bequeath unto Sarah Peter Mother of the said Edward Peter all that my Messuage and Tenement in Plymouth wherein I now live together with the Garden…. I give and bequeath unto John Culme(?) of Tothill Esquire and William Veale of Plymouth Apothecary £200 to be paid them within three months next after my death….and I hereby desire them to pay the same unto the Trustees for the time being of the Charity School in Plymouth of which Mr. John Mark is now Master and which was set on foot….by the charitable donations of Charles Stuckey(?) Esquire….upon the same terms as the said Charles Stuckey gave £100 to Trustees….reserving at the same time to the said William Veale alone during his life and

after his death to the said Roope Harris Roope and his Heirs the naming and putting in yearly upon the said Charity either a poor Boy or Girl as long as the same is supported and carried on Subject to the Rules of the said School by which such poor Children are admitted. I give and bequeath to the Poor Widows living in the Alms or Gift Houses at or near Cockside in Plymouth endowed by Joseph Jory Esquire £5 to be distributed unto and between them by my Executor hereinafter named within one month next after my decease.

To the Minister for the time being of the Parish of Charles in Plymouth £20 to be paid to him and to be distributed by him within one month next after my decease amongst such poor people of the said Parish of Charles that do not receive pay as poor as he shall think fit Objects of Charity, and the Guardians of the Poor of Plymouth are not to meddle therewith.

I give and bequeath £5 to each of the several Parishes of Churston Ferrers, Halwell, Dittisham and North Huish to be distributed by and at the discretion of my Executor within one month next after my death unto and among such poor People of each Parish (not receiving pay as such) as he shall think do stand in need of the same.

To the said William Veale and Roope Harris Roope and the survivor of them £700 in trust for the children of John Shepheard lately deceased (who was one of the sons of my cousin Jane Shepheard late of Modbury co. Devon widow also deceased) which shall be living at the time of my death,in equal shares when and as they attain age 21….

To Richard Roope of Kingsbridge Surgeon £200 in Trust for his daughter Margt Roope (my God Daughter) to be paid to her at age 21….on condition that he the said Richard Roope do pay a clear Annuity of £10 a year to his Mother Honor Roope….by four equal quarterly payments….and in case he shall refuse or neglect to do so, then I bequeath the same sum of £200 to the said Honor Roope….

To John Roope of His Majesty’s Victualling Office at Plymouth (Brother of the said Richard Roope) £400, the said John Roope paying a like clear Annuity of £10 a year to his mother Honor Roope during her life….and in default of his doing so, I bequeath £200 to Honor Roope….

To be paid to them at age 21.

To Margt Roope and Susannah Lavington Roope daughters of the said Roope Harris Roope £1000 each, to be paid to them at age 21, provided that in case either or both of them marry against the wishes of their father Roope Harris Roope, or if dead, of their mother Mary Roope, then these legacies to become void and be considered as part of the Residuum of my personal estate.

To John Larkworthy, Ambrose Larkworthy and James Larkworthy, sons of my late cousin Larkworthy of the City of Exeter deceased and Sarah his wife, formerly called Sarah Harris, £800 apiece. And if the said John Larkworthy who has a son and only Child (whose Christian name I know not) and Ambrose Larkworthy, who has several children, or either of them, shall happen to die, then direct to their children as above; And if the said James Larkworthy, who has no Issue, shall also die before me, then his legacy to be divided between John and Ambrose or their children. To William Shepheard and Benjamin Shepheard two other of the sons of my late cousin Jane Shepheard £800 apiece. To William Veale £400, or to his executors if he be deceased.

To my God Daughter Susanna White wife of Samuel White of Plymouth Surgeon £400.

To Jonah Lavington Veale Lieutenant of Marines (son of John Veale deceased) £300.

To Margaret Roope Larkworthy daughter of the said Ambrose Larkworthy £200.

To Mrs. Mary Kevern Wife of Mr Kevern a Shipwright whose maiden name was Coite £100 or, if she be dead, to her husband Mr. Kevern.

To Mr Walter Wakeham of Market (?Few)/(?Jew) in Cornwall £100, or if he be dead, to his only daughter, whose name I do not now recollect.

To the several sisters of the Reverend Mr Samuel Lavington of Biddeford, whose names I do not remember nor how many they are in number, £100 to be equally divided between them.

To the said William Veale, Susanna White & Jonah Lavington Veale £100 to be divided equally between them, which legacy of £100 I intended to have given the late Mrs Abigal Veale, Mother of the said William Veale and Susanna White had she outlived me.

To the wife of the late William Langdon, whose Christian name I have forgot, £50.

To Miss Susanna White, Miss Frances Elizabeth White, Miss Eliz. White & Miss Sarah White, the four daughters of the said Samuel & Susanna White, £50 apiece.

To Mrs Crew otherwise Cruwys, now or late of Brixham, Widow, £50, or if she die to her daughter.

To Mrs Susanna Hanley and Mrs Mary Hanley her sister, daughters of a sister of the before named Abigal Veale, £40 each.

To Prudence Eastridge, wife of John Eastridge of Plymouth, Mason, £15.

To Mrs Cutheridge, sister of the said William Creed, £10.

To William Veale £10 for mourning.

To Grace Kemp and my former servant Ann ?Loon - now the wife of Henry Perrying, £10 each.

To my servants Mary Pollexfen and Ann Clay £10 each provided they shall be living with me at the time of my death.

To the said Doctor Andrew Lavington, the Reverend Samuel Lavington, Mr. William Lavington, Apothecary, Mrs. Limbrey, wife of Mr. Limbrey of Little Dartmouth, Mrs Frances Ilbert, wife of William Ilbert Esquire, and Doctor Richard Veale, brother of the said William Veale, £5-5-0 apiece for a ring in remembrance of me.

To the said Sarah Peter (the Mother), Mrs Elizabeth Veale, wife of the said William Veale, the said Susanna White (the Mother) and Elizabeth Daws £1-1-0 each for a Mourning Ring.

To the four children of James Roope of Kingsbridge whose names I do not know, a Mourning Ring each of a Guinea value.

To the said Sarah Peter (the Mother) my best diamond ring.

To the said Susanna White (the Mother) my Gold Chain, Gold Buttons and a Mourning Ring for the late Mr. Lavington.

To the said Miss Susanna Lavington Veale, my diamond ring which I had for a Mourning Ring for my first Husband.

To the said Edward Peter my silver Coffee Pot marked EP.

To the said Margaret Roope and Susanna Lavington Roope (daughters of the said Roope Harris Roope) all my China of every kind equally, share and share alike.

To the said George Roope and Jonah Lavington Roope (sons of the said Roope Harris Roope) all the remainder of my plate not by me hereinbefore given, equally share and share alike.

To the first named John Roope all my Delph or Earthen ware.

To each of my servants that shall be living with me at the time of my death a full suit of mourning.

To the said Roope Harris Roope and his heirs all Manors, Messuages, Lands, Tenements & Hereditaments….which now are or shall be mortgaged in fee or conveyed by way of mortgage to me in fee…. All the Rest, Residue and Remainder of my estate to Roope Harris Roope, to be sole executor. 8 May 1775

First codicil 28 Feb 1776:-
John Larkworthy & Ambrose Larkworthy being lately dead, and their legacies of £800 apiece having lapsed, I now revoke these two legacies, and also the legacy of £800 to James Larkworthy, and instead do give and bequeath to the son and only child of the said deceased John Larkworthy (whose name I do not know) £400.

To Roope Harris Roope and James Larkworthy and the survivor of them £400, in Trust to the widow of the said John Larkworthy (whose name I cannot recollect) during her life, and on her death to the said only son of John Larkworthy. To the three sons of Ambrose Larkworthy deceased (whose names I have forgot) £100 apiece.

To Roope Harris Roope & James Larkworthy and the survivor of them £500 in Trust to the widow and only daughter of the said Ambrose Larkworthy during their natural lives and the life of the longer liver of them, and on their death, to the said three sons of Ambrose Larkworthy in equal shares.

To the said James Larkworthy (who has no issue) £800; if he dies before me, £200 to the only son of John Larkworthy, £200 to the three sons of Ambrose Larkworthy, and £400 to Roope Harris Roope in Trust to pay to the widow of the said James Larkworthy for her life. And on her death, the Principal or Trust Money of £400 to be divided between the son of John Larkworthy & the three sons of Ambrose Larkworthy.

To the child of which Mrs Mary Roope wife of Roope Harris Roope is now enceint (being her fifth child) £1000, to be paid in the same manner as the legacies to the other children of Roope Harris Roope; and if the child be a daughter, then subject to the same proviso as the legacies to his other daughters marrying under the age of 21. 28 Feb 1776.

John Roope of H.M.Victualling Office (brother of Richard Roope) has died since the date of the first codicil, so his legacy lapses, and instead, To Honor Roope his Mother an annuity of £20 to be paid quarterly out of the Residuum of the Estate. 13 July 1776.
