This is the Last and Testament / of me Ann Rawes the Wife of Richard Rawes of Stratford Grove / in the County of Essex Esquire Whereas by an Indenture Bearing

date the twenty seventh day of November one thousand eight hund / red and twenty eight the same being granted as so far as it operated as / a release on a previous lease for a year and being made or expressed to / be made between myself then Ann Bayley Widow of the first part the / said Richard Rawes of the second part and Francis Bayley of Sandon / in the said County of Essex Esquire George Killirt of Maryland \ Point in the same County Wine Merchant and William Thompson Rawes of Brom / ley in the County of Kent Esquire of the third part being a settlement / made previously to my Marriage with the said Richard Rawes two Copy / hold messuages or tenements with the Copyhold gardens and appurtenan / ces thereto respectively belonging situate and being at Stratford Grove afore / said one of which messuages or tenements was then in my own occupa / tion and is now in the occupation of the said Richard Rawes and my / self and the other of which was then in the occupation of             Ingram / and is now in the occupation of             Scappe[?] were respectively / covanented to be surrendered as regards the said firstly mentioned mes / uage or tenement and premises To the use of the said Richard Rawes his / heirs and assigns for ever according to the custom of the Names of West / Obam[?] whereof the same was holden and as regards the said firstly men / tioned messuage or tenement and premises being those now as aforesaid / in the occupation of the said Richard Rawes and myself To the use of / the said Francis Bayley George Killirt and William Thompson Rawes / their heirs and assigns for ever according to the Custom of the same Names / upon the trusts thereinafter deceased and in part hereinafter mentioned / and by the aforesaid Indenture of Settlement a piece of freehold land / therein described and which had been added to and then formed part of / the Gardens of the aforesaid messuages or tenements was conveyed to the / use after the solemnization of my marriage with the said Richard / Rawes as to go with thereof and was held with the said messuage or / tenement therein the tenure of the said             Ingram of the said / Richard Rawes his heirs and assigns for ever And as to the remainder / of the same piece or parcel of land or ground which adjoined to and / was held with the aforesaid messuage or tenement then in my own / occupation and now as aforesaid in the occupation of the said Richard / Rawes and myself To the use of the said Francis Bayley George Kil / lirt and William Thompson Rawes their heirs and assigns upon the trusts / in the said Indenture declared and in part hereinafter mentioned and it was by / the same Indenture declared that the said Francis Bayley George Killirt / and William Thompson Rawes and their heirs should after the solemniza / tion of my marriage with the said Richard Rawes stand siezed of the / Copyhold messuage or tenement and hereditaments then as aforesaid in / my occupation and now in the occupation of the said Richard Rawes / and myself with the freehold garden and hereditaments thereto adjoining / upon trust for the said Richard Rawes and his assigns for his life and / after his decease upon trust for myself for my life and after the decease / of the Survivor of the said Richard Rawes and myself In trust for my / daughter Helen Julia Bayley for her life and after her decease in trust for / all the Children of the said Helen Julia Bayley who being a Son or / Sons should attain the age of twenty one years or being a daughter / or daughters should attain that age or marry in equal shares as tenants / in common and their respective heirs and assigns and if there should be / no Child of the said Helen Julia Bayley who should attain a vested /interest in the said last mentioned messuages or tenements garden and / hereditaments in trust for such person or persons as I should by any deed / writing or by my last Will and Testament in writing or by any Codi / cil thereto to be executed by me in the presence of two or more witnesses / notwithstanding coverture appoint and in default of such appointment in / trust for the said Helen Julia Bayley her heirs and assigns for ever and by

the aforesaid Indenture of Settlement I did with the consent of the / said Richard Rawes assign to the said Francis Bayley George Killirt and / William Thompson Rawes their executors administrators and assigns all / the furniture plate china books pictures utensils articles goods chatt / els and effects whatsoever of or belonging to me and in upon and at / about the messuage garden and premises then as aforesaid in my occu / pation and now in that of the said Richard Rawes and myself To hold / the same upon trust for such powers intents and purposes as I should / notwithstanding my coverture by deed or writing or by my Will in writing / or any Codicil thereto in writing appoint with such trusts in default of such / appointment as in the same Indenture mentioned and after stating in / accordance with the fact[?] the transfer by me of the Sum of ten thousand / pounds three per cent Consolidated Bank Annuities unto the names of the / said Francis Bailey George Killirt and William Thompson Rawes [----- / --?] the same Indenture declared that they their executors administrators and / assigns should stand possessed of the same sum of ten thousand pounds / three per cent Consolidated Bank Annuities upon trust after the solemniza / tion of my marriage with my said Richard Rawes and thenceforth during / our joint lives to apply and dispose of the dividends thereof in manner therein / mentioned and if the said Richard Rawes should survive me then upon trust / from and after my decease and therefourth during his life to pay to him / the whole of the dividends of the same sum of ten thousand pounds / three per cent Consolidated Bank Annuities for his own use with a fur / ther trust to take effect for my benefit after the decease of the said / Richard Rawes in the event of my surviving him And it was by the said / Indenture declared that after the decease of the survivor of the said / Richard Rawes and myself the aforesaid Sum of ten thousand pounds / three per cent Consolidated Bank Annuities should be held upon trust for / all or such one or more of our Children or for the issue born in the life / time of us or of the survivor of us of any one or more of such Child / ren or such time or times not more remote than twenty one years / next after the decease of the survivor of us and in such manner and / if more than one in such shares and with such maintenance as I / notwithstanding my coverture should by such deed or deeds instrument / or instruments in writing as therein mentioned or by my last Will and / Testament in writing or any Codicil or Codicils thereto to be signed and / published by me in the presence of and attested by two or more credible / Witnesses appoint and in default of such appointment then as the said / Richard Rawes should after my decease in manner therein mentioned / appoint and in default of such appointment then in trust for all and every / the Child or Children of me by the said Richard Rawes who being a / Son or Sons should attain the age of twenty one years or who being a / daughter or daughters should attain that age or marry which should / first happen to be divided between them if more than one in equal share / but it was by the same settlement provided that in case there should / not be any Child of me by the said Richard Rawes who should obtain / a vested interest in the said trust funds and in case the said Richard / Rawes should survive me then the same sum of ten thousand pounds / three per cent consolidated Bank Annuities should after the decease of the / said Richard Rawes and such failure of issue as aforesaid be held upon / trust for such person or persons as I should notwithstanding any new / Coverture by Deed sealed and delivered and attested as therein mentioned / or by my last Will and Testament in writing or any Codicil thereto to be / signed and published by me in the presence of and attested by two or / more Credible Witnesses appoint and in default of such appointment / then as in the same Indenture mentioned and there is contained in my aforesaid marriage Settlement a Stipulation that after the solemnization

of the marriage Between the said Richard Rawes and myself appli / cation should be made to Her Magesty's High Court of Chancery for / obtaining a transfer unto the Trustees or Trustee for the time being / acting in the trusts of the same Indenture of such part of a Sum of / thirteen thousand pounds three hundred and eighty two pounds nine shillings / and two pence three per cent Consolidated Bank Annuities therein men / tioned to be then standing in the name of the Accountant General of the / said Court of Chancery in trust in a cause of "Bayley & Bancroft" and / others as should remain after such deductions therefrom as in the said Inden / ture mentioned which residue or surplus of the Sum of thirteen thousand / three hundred and eighty two pounds nine shillings and two pence / three per cent Consolidated Bank Annuities it was by the said Indenture / declared should be here upon and for the same trusts in tents and purposes / and with and subject to the same powers provisoes and agreements / except as therein mentioned as were thereinbefore declared and expressed / of and concerning the aforesaid trust fund of ten thousand pounds three / per cent consolidated Bank Annuities or such of them as at the time of / such transfer should or subsisting and capable of taking effect but not / as to increase a certain annuity made payable to me for my separate / use betwixt the joint lives of the said Richard Rawes and myself And whereas the trust fund of / ten thousand pounds three per Cent Consolidated Bank Annuities the / trusts whereof were declared by my aforesaid marriage Settlement as / hereinbefore mentioned hath since the execution of the same Settlement / been diminished by divers sales made thereout in accordance with powers / contained in the same Settlement and enabling the trustees necessary in that / behalf but the same trust fund with the addition thereto of the Sum of / two thousand five hundred and eighty two pounds four shillings and three / pence three per Cent Consolidated Bank Annuities the residue of the afore / said Sum of thirteen thousand three hundred and eighty two pounds nine / shillings and two pence of life Annuities which hath been added thereto / in accordance with the aforesaid Settlement now amounts to the Sum of / nine thousand nine hundred pounds of those annuities or thereabouts / And whereas Richard Bayley of Paundon[sic] in the County of Essex Esquire / was previously to the purchase next hereafter mentioned or referred / to appointed to act as a trustee under my aforesaid marriage Settlement / in the place of the said William Thompson Rawes by virtue of a power of appointing new Trustees contained in the same Settlement and the / aforesaid trust fund of nine thousand nine hundred pounds three per / cent Consolidated Bank Annuities is now standing in the names of the / said Francis Bayley George Killirt and Richard Bayley as trustees under / the same settlement And whereas sometime in or about the year one / thousand eight hundred and thirty five the said Francis Bayley George / Killirt and Richard Bayley did as trustees under my aforesaid marriage / settlement and in pursuance of the power of purchasing freehold or copy / hold estates contained in the same Settlement and hereinbefore mentioned / or referred to purchase of the said Richard Rawes the Copyhold messuage / or tenement garden and premises and the freehold ground added to or hold / as part of the same garden to which under my said Marriage Settlement / the said Richard Rawes had become equitably entitled in fee simple being / the Messuage or tenement garden and premises their as aforesaid in the / occupation of the said             Ingram and now in the occupation of /             Scappe[?] the purchase money for the same messuage or

tenement and premises having been raised and paid to the said / Richard Rawes by means of one of the sales of Stock hereinbefore / referred to as made in diminution of the aforesaid trust fund of ten / thousand pounds three per cent Consolidated Bank Annuities and about / the same period the said Francis Bayley George Killirt and Richard Bay / ley as such Trustees as aforesaid obtained on enfranchisement as took of / the Copyhold messuage or tenement last aforesaid and of the Copyhold / part of the garden and appurtenances thereto as also of the Copyhold mes / uage or tenement now as aforesaid in the occupation of the said Richard / Rawes and myself and of the Copyhold part of the Garden and appurtenances / collects the money paid for such enfranchisement having been also caused by income / of one of the sales of Stock hereinbefore mentioned or referred to as having been / made in diminishen of the aforesaid trust fund of ten thousand pounds / three per cent Consolidated Bank Annuities and in conveyance of such pur / chase from the said Richard Rawes as hereinbefore mentioned the messuage or tenement and hereditaments[?] as purchases[?] franchisings[?] / aforesaid became and still continues subject in equity to the same trusts as the / aforesaid sum of nine thousand nine hundred pounds three per cent Consolidated / Bank Annuities was and is subject to or affected by under or by virtue of the / aforesaid marriage Settlement and whereas immediately before the date of the / Indenture next hereinafter mentioned the said Richard Rawes was under or / by virtue of the trusts or provisions of my aforesaid marriage Settlement / beneficially entitled for his life to the rents and profits of both the aforesaid / two several messuages or tenements with the Gardens and appurtenances there / to and also subject only to the payment during our joint lives of an annui / ty of two hundred pounds payable thereout to my separate use during our / joint lives to the dividends and annual produce of the aforesaid Sum of nine / thousand nine hundred pounds three per cent consolidated Bank annuities / set[?] by an Indenture of assignment bearing date about the twelfth day / of April one thousand eight hundred and thirty five and made or expressed to / be made between the said Richard Rawes of the first part myself of the / second part and the said Francis Bayley George Killirt and Richard Bayley of / the third part the said Richard Rawes did for the considerations therein mentioned / assign to the said Francis Bayley George Killirt and Richard Bayley the life / inter / est of him the said Richard Rawes as well in the aforesaid two several / messuages or tenements and the gardens and appurtenances thereto as / also in the aforesaid Sum of nine thousand nine hundred pounds three per / Cent consolidated Bank Annuities upon trust for my separate use during our / joint lives and in case the said Richard Rawes should survive me then / I will and after my decease upon trust for such person or persons and in / such manner and for such purchases as I should notwithstanding any cover / ture by deed sealed and delivered in the presence of and attested by two or / more witnesses or by my last Will and Testament in writing or by any wri / tings in the nature of or proportion to be my last Will and Testament to / be signed by me in the presence of and attested by the like number of / Witnesses appoint and in default of such appointment upon trust for the / said Richard Rawes And whereas under or by virtue of my aforesaid / marriage Settlement and of the Sales and Assurances hereinbefore men / tioned or referred as having been made by the said Richard Rawes I have / power by this my Will to make such appointments in favor of Ann / Rawes and Richard Edward Rawes my two Children by the said Richard / Rawes and of William Wilson Rawes and Mary Ann Rawes the Children of / the said Richard Rawes by his former Wife as those hereinafter contained / Now I do by this my last Will and Testament signed and attested as by / Law required direct and appoint that the messuage or tenement garden and / premises hereinbefore mentioned or referred to as having been sold by the said / Richard Rawes to the trustees of my aforesaid Marriage Settlement or the / monies Stocks funds or securities which shall or may hereafter represent the / same and also the aforesaid trust fund or sum of nine thousand nine hund / red pounds three per cent Consolidated Bank Annuities shall from and after

the decease of the said Richard Rawes and myself be held upon trust for the / said Ann Rawes and Richard Edward Rawes and to be vested in interest in / the said Ann rawes if and when and not before she shall attain the age / of twenty one years or be previously married and in the said Richard Edward / Rawes if an when and not he shall attain the age of twenty one / years and so that if both of them shall attain vested interests in the said / trust premises the same shall be equally divided between them as tenants / in common and if only one of them shall attain a vested interest in the same / trust premises then such one of them shall be entitled to the whole of such trust premises but if the / said Richard Rawes shall depart this life under the age of twenty one years without being or having been / married and the said Richard Edward Rawes shall also depart this life under / the age of twenty one years then from and after the decease of the survivor of them / the said Richard Rawes Ann Rawes and Richard Edward Rawes the same trust / premises shall be held by the Trustees or Trustee for the time being of my afore[said?] / marriage Settlement upon the trusts following that is to say as to so much and / such part of the same trust premises as at the time of the decease of such / Survivor shall be of the value of two hundred pounds sterling upon trust for the / said William Wilson Rawes and Mary Ann Rawes to be equally divided / between them as tenants in common and their respective executors administrators / and assigns and as to all the net[?] residue and remainder of the same trust Pre / mises upon trust for the absolute use and benefit of the said Francis Bayley his executors administrators / and assigns and I further direct and appoint that so long if at all after the / decease of the said Richard Rawes and myself the said Ann Rawes shall be under the age of twenty one years and unmarried the Income of the trust pre / mises to which she shall for the time being be entitled or so much of such income / as the Trustees or Trustee for the time being of my aforesaid marriage Settlement / shall think proper shall be applied by such Trustees or Trustee for her maintenance / support and education or otherwise for her benefit or advancement in the world / and that so long if at all as after the decease of the said Richard Rawes and / myself the said Richard Edward Rawes shall be under the age of twenty / one years the income of the trust premises to which he shall for the time / being be entitled or so much of such income as the said Trustees or Trustee for / the time being than think proper shall be applied by such Trustees or Trustee / for the maintenance support and education or otherwise for his benefit or / advancement in the world and in pursuance of the power of appointment / given to or vested in me by the aforesaid Indenture of assignment of the twelfth / day of April one thousand eight hundred and thirty five and of every other form[?] / enabling me in this behalf I do by this my last Will and testament direct / and appoint that if the said Richard Rawes shall survive me then the / dividends and annual produce which from and after my decease and thence / forth during the life of the said Richard Rawes shall arise or become paya / ble from or in respect of the aforesaid Sum of nine thousand nine hundred / pounds three per cent Consolidated Bank Annuities or the Stocks funds or secu / ities which shall or may represent the same shall be held by the Trustees / or Trustee for the time being of my aforesaid Marriage Settlement upon trust / for my said Children Ann Rawes and Richard Edward Rawes equally to be / divided between them as tenants in common but that if the said Ann Rawes / shall depart this life in the life time of the said Richard Edward Rawes / and under the age of twenty one years and without being or having been / married then her part or share of the trust premises to which this appointment / relates shall so far as the same may not have been applied for her mainte / nance support aduration or benefit under the provision in that behalf hereinaf / ter contained be held upon trust for the said Richard Edward Rawes and if the said / Richard Edward Rawes shall die in the life time of the said Ann Rawes and / under the age of twenty one years then from and after the decease of the / said Richard Edward Rawes his part or share of the same premises shall / be held upon trust for the said Ann Rawes and if the said Ann Rawes shall / depart this life in the life time of the said Richard Edward Rawes and under the age / of twenty one years and without being or having been married and the

said Richard Edward Rawes shall also depart this life in the life time of / the said Richard Rawes and under the age of twenty one years then the same / lastly mentioned trust premises or so much thereof respectively as shall not have / been applied under the trust or provision next hereinafter contained shall form / and after the decease of the Survivor of them the said Ann Rawes and Richard / Edward Rawes but subject to the Proviso or qualification hereinafter contained / in relation of the interest of the said Richard Rawes therein under this my Will / or held upon trust for the said Richard Rawes Provided always and I further / direct and appoint that so long after my decease as the said Ann Rawes shall / be under the age of twenty one years and unmarried the interest dividends and / annual produce to which under the appointment lastly hereinbefore made for / her benefit she shall for the time being be entitled or so much thereof as the / Trustees or Trustee for the time being of my aforesaid marriage Settlement / shall think proper shall be applied by such Trustees or Trustee for or towards / her maintenance support and education or otherwise for her benefit and that so / long after my decease as the said Richard Edward Rawes shall be under / the age of twenty one years the Interest dividends and annual produce to / which under the appointment lastly hereinbefore made for his benefit he shall / for the time being be entitled or so much thereof as such Trustees or Trustee / shall think proper shall be applied by such Trustees or Trustee for or towards / his maintenance support and education or otherwise for his benefit And I direct and / declare that all Income hereinbefore made applicable to the maintenance sup / port and education of the said Ann Rawes and Richard Edward Rawes respec /tively may be so applied without reference to the ability of the said Richard / Rawes provide such maintenance support or education and in further pursu / ance of the Power of appointment lastly hereinbefore referred to one of every / other power enabling me in this behalf I do by this my Will direct and / appoint that if the said Richard Rawes shall survive me then (subject to / the Proviso or qualification next hereinafter contained) the said Richard / Rawes shall from the time of my decease and thenceforth during his life be / permitted and allowed to hold and enjoy the two several messuages or / Tenements hereinbefore mentioned or referred to with the Gardens and appur / tenances thereto and to receive and take the rents and profits thereof for his / own absolute use and benefit provided always and I hereby direct and / appoint that in case and from the time when the said Richard Rawes / shall after my decease be declared Bankrupt or take the benefit of my Act / or acts of Parliament made or hereafter to be made for the relief of Insol / vent debtors or shall sell or mortgage the life interests to which the two / several appointments hereinbefore made for his benefit respectively have / mention or any part of such life interests respectively or shall do any act / which but for this present Clause would amount to such Sale or mortgage / or to a disposition by way of anticipation of such life interests or either of / them or any part thereof respectively or whereby or in consequence whereof / the same Life interests or either of them or any part thereof respectively / would if the same had respectively belonged absolutely to him have become / vested in any other person or persons whomsoever or in case and from the / time when after my decease execution shall issue against the said Richard / Rawes upon any judgment entered up against him either in my life time / or afterwards then the same life interests or such of then as would but for / this present clause have become vested in any person or persons other / than the said Richard Rawes or have been affected by such execution as / shall immediately thereupon respectively cease to or subject to the appoint / ments hereinbefore made for the benefit of the said Richard Rawes and such / life interest or life interests respectively shall thenceforth be held by the Trus / ees or trustee for the time being of my aforesaid marriage Settlement upon / trust to apply and dispose of the same or as much thereof (and no more) / as they or he shall in their or his discretion think proper for the support / maintenance or benefit of the said Richard Rawes and so far as the same / life interests respectively shall not be so applied and disposed of as last afore / said the same shall be applied and disposed of in the same manner as the

dividends and annual produce of the aforesaid sum of nine thousand / nine hundred pounds three per cent consolidated Bank Annuities would / for the time being be applicable if the said Richard Rawes had departed / this life and in pursuance of the Power contained in my aforesaid / Marriage Settlement and enabling me in this behalf and of every other / power me thereunto enabling I do by this my last Will and Testament / direct and appoint that if there shall be no Child of my said daughter / Helen Julia Bayley who being a son shall attain the age of twenty / one years or who being a daughter shall attain that age or marry then / from and after the decease of the survivor of the said Richard Rawes / myself and the said Helen Julia Bayley and the failure of the trusts by / my aforesaid Marriage Settlement declared for the benefit of the Children / of the said Helen Julia Bayley the messuage or tenement and heredita / ments which as herein before mentioned were at the date of my aforesaid / marriage Settlement in my own occupation and which are now in the / occupation of the said Richard Rawes and myself with the Garden / hereditaments and appurtenances thereto belonging or appertaining shall / be held by the Trustees or Trustee for the time being of my aforesaid settle / ment upon trust for the said Ann Rawes and Richard Edward Rawes / the half Sister and half Brother of the said Helen Julia Bayley equally / to be divided between them as tenants in common and their respective / heirs and assigns for ever and in pursuance of the power contained in / my aforesaid marriage Settlement and enabling in this behalf and of / every other power me thereunto enabling I do by this my last Will and / Testament direct and appoint that from and immediately after my / decease the Trustees or Trustee for the time being of my aforesaid / marriage Settlement shall stand possessed of and interested in such of the / Chattels and effects by the same marriage Settlement assigned to the said / Francis Bayley George Killirt and William Thompson Rawes as hereinbefore / mentioned as shall consist of plates jewels trinkets and ornaments of the person / and the Cabinet of shells now standing in the drawing room of our house at / Stratford Grove aforesaid upon trust for my dear daughter Helen Julia Bayley / absolutely and as to all the rest residue and remainder of the same goods chat / els and effects upon trust for my dear husband the said Richard Rawes / during his life and from and after his decease upon trust for my said daughter / Helen Julia Bayley absolutely Provided nevertheless and I hereby direct and / appoint that the Life Interest of the said Richard Rawes under the appointment / lastly hereinbefore contained shall be subject to a Proviso for and in relation to / the determination thereof similar to the Proviso hereinbefore contained in relation / to the determination of the life Interests hereinbefore appointed to him except / only that after the determination under this present provision of the life interest / to which the same proviso has relation such life Interest shall except in so / far as the trustees or trustee for the time being of my aforesaid marriage settle / ment shall in their or his absolute discretion think proper to apply or [despair?] / of the same for the Personal benefit of the said Richard Rawes become and / be the absolute property of the said Helen Julia Bayley and whereas by an / Indenture bearing date the twenty sixth day of November one thousand eight / hundred and twenty eight and made or expressed to be made between the same / persons as are parties to the said hereinbefore in part recited Indenture of / Settlement of the twenty seventh day of the same month of November the / Indenture now in recital (being also made previously to my marriage with / my said present husband) the Sum of ten thousand pounds three per Cent Con / solidated Bank Annuities part of the aforesaid Sum of thirteen thousand three / hundred and eighty two pounds nine shillings and two pence life Annuities / then standing in the name of the Accountant General of the Court of Chancery / to the Credit of the aforesaid Cause of Bayley & Bancroft and other was / settled or agreed to be settled in case my said daughter Helen Julia Bayley / should die under the age of twenty one years and without having been mar / ried but not until after the decease of myself or of the said Richard Rawes / whichever of us should just die In Trust for such person or persons upon and

for such trusts intents and purposes and in such manner as I should / notwithstanding my coverture by any deed or deeds or by my last Will / and Testament in writing to be executed respectively by me in the presence of / and to be attested by two or more Witnesses appoint Now by virtue of the / power of appointment so given to or vested in me as lastly hereinbefore men / tioned and of every other power or authority enabling me in this behalf or do / by this my last Will and Testament direct and appoint that if my said daughter Helen Julia Bayley shall depart this life under the age of twenty / one years and without having been married all that the said lastly mentioned / sum of ten thousand pounds three per Cent Consolidated Bank Annuities shall / be had upon trust for the said Ann Rawes and Richard Edward Rawes / equally to be divided between them as tenants in common but that if the / said Ann Rawes shall depart this life in the life time of the said Richard / Edward Rawes and under the age of twenty one years and without being / or having been married then her part or share of the trust premises to which / this appointment relates shall be held upon trust for the said Richard Edward / Rawes and if the said Richard Edward Rawes shall die in the life time of / the said Ann Rawes and under the age of twenty one years then from and / after the decease of the said Richard Edward Rawes his part or share of / the same premises shall be held upon trust for the said Ann Rawes And if / the said Ann Rawes shall depart this life under the age of twenty one / years and without being or having been married and the said Richard / Edward Rawes shall also depart this life under the age of twenty one / years then the said lastly mentioned trust premises shall from and after the / decease of the survivor of them the said Ann Rawes and Richard Edward Rawes / be held upon the trusts following that is to say if the said Richard Rawes / shall be living at the decease of the survivor of them the said Ann Rawes / and Richard Edward Rawes then upon trust from and after the decease of / such survivor and thenceforth during the life of the said Richard Rawes but / subject to the proviso hereinafter contained for the determination of his life inter / est therein to pay the dividends and annual produce of the said Sum of ten / thousand pound three per cent consolidated Bank Annuities or of the funds / which shall or may represent the same unto the said Richard Rawes / for his own absolute use and benefit and from and after the decease of the / said Richard Rawes the same Sum of ten thousand pounds three per Cent / Consolidated Bank Annuities or the funds which shall or may hereafter / represent the same shall be held upon trust for such of the Children of the / said Francis Bayley and of John Bennington late of Jermyn Street in the / Parish of Saint James Westminster Brazier as shall be living at the time of / my decease and if more than one of such Children shall be then living / then equally to be divided between or among them as tenants in common / and their respective executors or [-----] administrators and assigns Provided / always and I hereby appoint direct and declare that in case and from / the time when the said Richard Rawes shall after my decease be declar / ed Bankrupt or take the benefit of any act or acts of Parliament made / or hereafter to be made for the relief of insolvent debtors or shall sell or / mortgage his life interest in the said lastly mentioned Sum of ten thou / sand pounds three per cent consolidated Bank Annuities or the funds / representing the same or any part of such life interest or shall do any / act which but for this present clause would amount to such sale or / mortgage or to a disposition by way of anticipation of such life interest / of every part thereof or whereby or in consequence whereof the same / life interest or any part thereof would if the same had belonged absolutely / to him have become vested in any other person or persons whomsoever or / in case and from the time when after my decease execution shall / issue against the said Richard Rawes upon any judgment entered up / against him either in my life time or afterwards then the same life

Proved at London the 26th May 1846 before the Worshipful / John Daubeny Dr of Laws and Surrogate by the Oaths of George Killirt / and Richard Edmund (in the will written Richard) Bayley two of the / Executors to whom admon was granted (limited so far only as contains all / the right titled and interest of the deceased in and to such personal estate / and effects as she the said deceased by nature of certain Indentures bear / ing date the 26th November 1828 and the 27th November 1828 had / right to appoint or dispose of and hath by her said Will appointed or / disposed of accordingly but no further or otherwise having been first / sworn duly to administer Power reserved of making the life grant to / Francis Bayley the other Executor when he shall apply for the same.

The place name in Essex appears to read Paundon. There is a placename of Sandon in Essex, mentioned earlier in the Will. 'Paundon' has not been traced.

William Thompson Rawes was the cousin of Richard Rawes.

Richard Rawes was the son of William Wilson Rawes of Wetsleddale in the parish of Shap, Westmorland. He was a Ship's purser in the HEICS.
